1. Acceptance of Terms

By accessing or using EssayMind ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("User") and EssayMind ("we," "our," or "us"). If you do not agree to any part of these Terms, you must immediately cease all use of the Service. Your continued use of the Service constitutes irrevocable acceptance of these Terms and any future modifications thereto.

2. Description of Service

EssayMind provides AI-powered tools for text generation, text rewriting, and text analysis. Our Service includes, but is not limited to:

  • AI Academic Writer: An outline generation and drafting tool that produces text based on user inputs.
  • AI Academic Humanizer: A text rewriting and rephrasing tool.
  • AI Content Detection: A text analysis tool that provides probabilistic estimates regarding text characteristics.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, without notice or liability to you.

3. Academic Integrity Disclaimer

Important Disclaimer

EssayMind is a general-purpose text processing and productivity tool. It is the user's sole responsibility to ensure that their use of the Service complies with all applicable laws, regulations, and institutional policies, including but not limited to the academic integrity policies of their educational institution. EssayMind does not encourage, promote, or facilitate academic dishonesty. We bear no responsibility for how users choose to use the output generated by the Service.

The Service provides text processing tools that may be used for a wide variety of legitimate purposes. How the user applies these tools is entirely within the user's own discretion and responsibility. We do not monitor, control, or restrict the user's downstream use of generated content.

4. User Responsibility

You acknowledge and agree that:

  • You are solely responsible for all content you submit to and receive from the Service.
  • AI-generated content may contain inaccuracies, errors, or fabricated information. You must independently verify all facts, citations, claims, and outputs.
  • The Service is provided as a tool, and the final responsibility for any use of its output rests entirely with you.
  • You must not use the Service in any way that violates applicable laws or the rights of any third party.
  • You agree to comply with all applicable laws and regulations in your jurisdiction regarding the use of AI-generated content.
  • You are solely responsible for ensuring compliance with your educational institution's policies regarding AI tools.

5. Prohibited Uses

Without limiting the generality of Section 4, the following uses are strictly prohibited:

  • Using the Service for any illegal purpose or in violation of any applicable laws or regulations.
  • Attempting to reverse-engineer, decompile, disassemble, or otherwise access the source code, algorithms, or underlying technology of the Service.
  • Using automated systems, bots, scrapers, or any means to access the Service in a manner that exceeds authorized use.
  • Interfering with or disrupting the integrity or performance of the Service.
  • Reselling, sublicensing, redistributing, or commercially exploiting the Service or its outputs without our express written consent.
  • Sharing account credentials with any third party or allowing unauthorized access to the Service.
  • Circumventing any usage limits, credit systems, or access controls implemented by the Service.

We reserve the right to determine, at our sole discretion, whether any use of the Service constitutes a prohibited use.

6. Account Registration and Security

  • You must provide accurate and complete information during registration and keep it updated.
  • You are responsible for maintaining the confidentiality and security of your account credentials. All activities under your account are your responsibility.
  • You must notify us immediately of any unauthorized access or use of your account. Failure to do so may result in liability for any resulting damages.
  • Each user may maintain only one account. We reserve the right to merge, suspend, or terminate duplicate accounts without notice.
  • We reserve the right to suspend or terminate your account at any time, for any reason, with or without notice.

7. Credits and Payments

  • The Service operates on a credit-based system. Credits are consumed upon use of our AI tools.
  • All credit purchases are final and non-refundable. No credits will be refunded under any circumstances.
  • Credits may expire at our discretion with prior notice.
  • We reserve the right to adjust credit pricing, credit consumption rates, and credit allocation at any time without prior notice.
  • Unused credits in terminated or suspended accounts are immediately forfeited with no compensation.
  • We reserve the right to offer promotional credits that are subject to additional terms and conditions, and may revoke promotional credits at any time.
  • We are not liable for any service interruptions that prevent the consumption of purchased credits.

8. Intellectual Property

  • The EssayMind platform, including all design, code, technology, algorithms, trademarks, logos, and branding, is our exclusive proprietary property, protected by applicable intellectual property laws.
  • By submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free, irrevocable, perpetual, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and otherwise exploit such content for any purpose related to the operation and improvement of the Service.
  • AI-generated output is licensed to you for personal, non-commercial use only. You may not reproduce, distribute, sublicense, or commercially exploit the output without our express written consent.
  • You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Any warranty that the Service will be uninterrupted, timely, secure, or error-free.
  • Any warranty that AI-generated content will be accurate, complete, reliable, or free from errors, hallucinations, or fabricated information.
  • Any warranty regarding the accuracy, reliability, or conclusiveness of AI detection results. Detection scores are probabilistic estimates provided for informational purposes only and should not be relied upon for any decision-making.
  • Any warranty that the Service will meet your specific requirements or expectations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ESSAYMIND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, profits, revenue, or business opportunities.
  • Academic penalties, disciplinary actions, grade reductions, or academic misconduct findings.
  • Personal injury, emotional distress, or reputational harm.
  • Any damages arising from inaccurate, incomplete, or hallucinated AI-generated content.
  • Any damages arising from inaccurate or unreliable AI detection results.
  • Any damages resulting from service interruptions, errors, bugs, or security breaches.
  • Any damages arising from third-party actions, including actions by AI model providers, payment processors, or other service partners.

IN NO EVENT SHALL OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE THIRTY (30) DAYS PRECEDING THE CLAIM, OR ZERO IF NO PAYMENT WAS MADE IN THAT PERIOD.

11. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS ESSAYMIND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES AND COURT COSTS) ARISING FROM OR RELATED TO:

  • Your use of or inability to use the Service.
  • Your violation of any provision of these Terms.
  • Your violation of any applicable laws, regulations, or third-party rights.
  • Any content you submit to or receive from the Service, including any claims of infringement, plagiarism, academic dishonesty, or misconduct related to such content.
  • Any disputes between you and any third party arising from your use of the Service.
  • Any unauthorized access to your account resulting from your failure to maintain account security.

This indemnification obligation shall survive the termination of your account and these Terms.

12. AI Detection Disclaimer

Our AI Content Detection tool provides probabilistic estimates regarding text characteristics. These results are provided for informational and reference purposes only. AI detection is an inherently imprecise and evolving field, and detection scores may vary significantly across different tools, models, and contexts. We make absolutely no guarantees, representations, or warranties regarding the accuracy, reliability, or conclusiveness of any detection results. Users acknowledge that detection scores should not be relied upon for any purpose and that we bear no liability for any consequences arising from the use of or reliance on such scores.

13. Termination

  • We reserve the right to suspend, restrict, or terminate your access to the Service at any time, for any reason, with or without prior notice or explanation.
  • Upon termination, all credits are immediately forfeited with no refund or compensation. All data associated with your account may be deleted at our discretion.
  • Provisions that by their nature should survive termination, including but not limited to intellectual property, disclaimer of warranties, limitation of liability, and indemnification, shall remain in full force and effect indefinitely.

14. Modifications to Terms

We reserve the right to modify, amend, or replace these Terms at any time, for any reason, and without prior notice to you. Changes become effective immediately upon posting the updated Terms on our website. Your continued use of the Service after any changes constitutes your irrevocable acceptance of the modified Terms. It is your sole responsibility to review these Terms periodically for changes.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to its conflict of law provisions. You irrevocably submit to the exclusive jurisdiction of the courts of Hong Kong SAR for any disputes arising from or related to these Terms or the Service. You waive any right to bring legal action against us in any other jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
